TERMS AND CONDITIONS (B2C)
1. INTRODUCTORY PROVISIONS
These terms and conditions (hereinafter "terms and conditions") of the entrepreneur Vojtěch Coufal, ID No.: 17581966, with its registered office at Brodská 1934/39, 591 01 Žďár nad Sázavou, registered in the Trade Register, business name: sestav si počítač (hereinafter "the Seller"), regulate in accordance with the provisions of Section 1751(1) of Act No. 89/2012 Coll., the Civil Code (hereinafter "the Civil Code"), the mutual rights and obligations of the contracting parties arising in connection with the purchase contract concluded between the Seller and the consumer through the online store available at the website www.sestavsipocitac.cz.
These terms and conditions apply exclusively to cases where the buyer is a consumer within the meaning of Section 419 of the Civil Code.
Provisions deviating from these terms and conditions may be agreed in the purchase contract. Such agreements shall take precedence.
The purchase contract and terms and conditions are drawn up in the Czech language. The contract may also be concluded in the English language.
2. DEFINITION OF OFFERED GOODS
The Seller offers:
· goods – standard products without modifications at the buyer's request, · custom-made goods – in particular computer assemblies assembled or modified according to the individual requirements of the buyer.
3. CONCLUSION OF PURCHASE CONTRACT FOR "GOODS"
All presentation of goods on the web interface of the store is of an informative nature and does not constitute an offer to conclude a contract within the meaning of Section 1732(2) of the Civil Code.
The Buyer places an order via the order form.
Before sending the order, the Buyer is allowed to check and change the entered data.
The contractual relationship is established upon delivery of the confirmation of acceptance of the order by the Seller.
The Seller shall send the Buyer confirmation of the conclusion of the contract in text form (by e-mail) without undue delay.
4. PRICE FOR "GOODS" AND PAYMENT TERMS
Prices are quoted including VAT and all fees.
The Buyer may pay the price for the goods (i) cashlessly via the GoPay online payment gateway (www.gopay.com), (ii) by bank transfer to account no. 7001073369/0800 held with Česká spořitelna, a.s., (iii) by cash on delivery, or (iv) in cash upon personal collection.
The Seller does not require a deposit or similar payment from the Buyer. The Seller is a VAT payer.
5. CONCLUSION OF PURCHASE CONTRACT FOR "CUSTOM-MADE GOODS"
All presentation of goods on the web interface of the store is of an informative nature and does not constitute an offer to conclude a contract within the meaning of Section 1732(2) of the Civil Code.
To request a specific computer assembly, the Buyer fills out an inquiry form. The Buyer can choose between assembly: (i) "PC assembly basic", (ii) "PC assembly individual", or (iii) "TOP assembly".
The contractual relationship between the Seller and the Buyer is established upon confirmation (acceptance) of the inquiry.
6. PRICE FOR "CUSTOM-MADE GOODS" AND PAYMENT TERMS
The price for custom-made goods and any costs associated with the delivery of the goods shall be paid by the Buyer to the Seller cashlessly by transfer to account no. 7001073369/0800 held with Česká spořitelna or by paying at the premises in cash. The Seller requires a deposit of 70% (seventy percent) of the agreed price for custom-made goods from the Buyer. The remaining part of the agreed price, i.e. the balance of 30% (thirty percent), shall be paid by the Buyer before or upon receipt of the goods, unless otherwise agreed. The Buyer is also entitled to pay the full purchase price in advance (100%).
7. WITHDRAWAL FROM CONTRACT FOR "GOODS" AND "CUSTOM-MADE GOODS" – CONSUMER CONTRACTS
The Buyer has the right to withdraw from the contract for goods within 14 (fourteen) days. The period runs from the day of receipt of the goods.
For withdrawal, the Buyer may use the sample form provided by the Seller.
If the Buyer withdraws from the purchase contract for goods, they shall send or hand over the purchased goods to the Seller without undue delay.
The Buyer shall bear the costs associated with the return of the goods, unless otherwise agreed.
The Seller shall return all monetary funds received to the Buyer within 14 days from the date of withdrawal from the contract, but not before the Buyer returns the goods to them.
The Buyer does not have the right to withdraw from the contract in the cases specified in Section 1837 of the Civil Code, in particular for goods modified according to the Buyer's wishes or for their person (i.e. custom-made goods).

Goods are deemed to be delivered and accepted: (i) upon receipt at the address designated by the Buyer or (ii) upon personal collection at the Seller's branch.
The Buyer is obliged to inspect the goods upon receipt.
9. DISPATCH AND TRANSFER OF GOODS
The risk of damage passes to the Buyer upon receipt of the goods. For the avoidance of doubt, in the case of dispatch via a carrier, the risk of damage passes at the moment the Buyer takes receipt of the goods.
10. RIGHTS FROM DEFECTIVE PERFORMANCE
The Seller is liable to the Buyer that the goods or custom-made goods are free from defects upon receipt.
The Buyer may exercise rights from a defect that manifests itself within two years of receipt.
In the event of a defect, the Buyer has the right to: (i) removal of the defect by repair, (ii) delivery of a new item, (iii) a reasonable discount, (iv) withdrawal from the contract (in cases prescribed by law).
A complaint will be handled without undue delay, but no later than within 30 days.
11. DEFECTIVE AND LATE PERFORMANCE
Consumer complaints are handled by the Seller via the e-mail address info@sestavsipocitac.cz. The Czech Trade Inspection Authority (www.coi.cz) is competent for out-of-court resolution of consumer disputes arising from the contract.
12. PROTECTION OF PERSONAL DATA
The protection of personal data is governed by a separate document - Privacy Policy.
13. FINAL PROVISIONS
If a relationship established by contracts contains an international (foreign) element, the parties agree that the relationship is governed by Czech law.
These terms and conditions are effective as of 28.4.2026.

9. RIGHTS FROM DEFECTIVE PERFORMANCE
The Seller is liable to the Buyer that the goods have the properties agreed in the contract at the time of transfer of the risk of damage, or the usual properties.
The Buyer is obliged to inspect the goods without undue delay after receiving them and to ascertain their properties and quantity.
Rights from defective performance must be exercised by the Buyer without undue delay after discovering the defects or when they should have been discovered with professional care, but no later than within 12 months from the transfer of the risk of damage to the goods. Later claimed defects shall not be considered, unless otherwise provided.
In the case of a justified complaint, the Buyer has the right at the Seller's option to: (i) removal of the defect by repair, (ii) delivery of replacement goods, (iii) a reasonable discount from the purchase price.
Withdrawal from the contract is possible only in the event of a material breach of contract within the meaning of Section 2106 of the Civil Code.
The Seller is not liable for defects caused by improper use, unprofessional intervention or normal wear and tear.
10. PROTECTION OF PERSONAL DATA
The protection of personal data is governed by a separate document - Privacy Policy.
11. FINAL PROVISIONS
If a relationship established by contracts contains an international (foreign) element, the parties agree that the relationship is governed by Czech law.
